Question: Per the Plans there are 32 Ground Mounted Signs to be installed in the Mandatory Avoidance Areas as specified in Section 108.04 Page 17 Paragraphs 8-12. Paragraph 11 sentence 2 specifically states "DO NOT PARK OR TURN AROUND VEHICLES, STAGE ACTIVITY, SET POSTS, GRUB, MECHANICALLY SEED, TRENCH, STORE MATERIAL OR CONDUCT ANY GROUND-DISTURBING ACTIVITIES OFF THE TOE-OF-SLOPE REGARDLESS OF ANY PREVIOUS DISTURBANCE". Based on this paragraph and the very specific wordings of "SET POST OR CONDUCT ANY GROUND-DISTURBING ACTIVITIES OFF THE TOE-OF-SLOPE REGARDLESS OF ANY PREVIOUS DISTURBANCE". This would mean that these signs would be eliminated from these very specific areas as specified per the project specifications. The following mandatory avoidance areas for this project are located at the following: US 95 mp NY 6.00 – NY 7.00 (both side of the highway) US 95 mp NY 8.00 – NY 12.00 (both sides) US 95 mp NY 63.00 – NY 64.00 (both sides) US 95 mp NY 66.00 – NY 72.00 (both sides) Will NDOT please release an addendum updating the sign schedule and bid items deleting the signs in these areas which will reduce the quantities of signs from 121 locations to 89 locations and reduce the SF bid item from 1,252 SF to 942 SF? If these signs are not eliminated and fines and / or project shut down does occur how will the contractor be compensated for the penalties and project delays for installing signs in the MANDATORY AVOIDANCE AREAS? |
Answer: Within the mandatory avoidance areas, contractor shall install signs eight feet from edge of pavement. There should be sufficient horizontal clearance to keep all construction activities within the toe-of slope per Section 108.04 of the Special Provisions. An updated plan set will be issued. |
