| Answer: October 15th represents TRPA's end of soil disturbances for the season, not a suspension of work. If critical path work requires a TRPA grading exception to meet the requirements of the TRPA permit, and the grading exception is not obtained, then a temporary suspension of work may be granted by the Engineer per Subsection 108.06 of the Standard Specifications. In lieu of moving the NTP, will the department apply for and procure the US Fish and Wildlife Incidental Take Permit to allow construction to start within the 2026 Season? | Answer: The following Paragraph was updated in the Specifications and included in Addendum #1. Access to the work site for Bird Mitigation prior to the NTP may be granted by the Resident Engineer.
Disturbances shall be conducted in a manner that avoids impacts to protected birds that may be actively utilizing land, vegetation, or structures for nesting. Land, vegetation, or structure disturbances occurring during avian nesting season (generally March 1 through July 31) will require nesting surveys conducted by an approved biologist with experience in bird identification, general nesting behavior, nest and egg identification, and knowledge of habitat requirements for migratory birds. Submit a copy of the biologist’s curriculum vitae for approval by the Department’s Environmental Services Division prior to the preconstruction meeting. Conduct nesting surveys no more than 7 days prior to any construction activities, including mobilization, land disturbance, vegetation removal, and structure disturbance. If temporary suspensions or disruptions to construction activities greater than 7 consecutive days occur, a new nesting survey will be required prior to resuming construction activities. Nesting surveys shall be documented in survey reports and submitted for approval by the Department’s Environmental Services Division prior to commencing land, vegetation, or structure disturbances. |

| Answer: The clearing and grubbing bid item quantity includes any area where we will be disturbing the site but, not salvaging and replacing the topsoil. This accounts for the work required to clear the site for areas such as paving, concrete, and stairs. |
