| Answer: The topsoil salvage quantity was included in the roadway excavation quantity. We will provide updated quantities in an addendum. |

| Question: Section 102.05 says to obtain and adhere to measures & requirements, but the environmental memo says there is a programmatic categorical exclusion. Can you confirm if we need the BO (can you provide if so) and if we have to adhere to it so we know how to bid? |
| Answer: The contractor must adhere to measures within NDOT's Programmatic Biological Opinion for the desert tortoise. The PBO can be obtained by emailing kholcomb@dot.nv.gov. |

| Question: Plan sheet 3A says per the note excess roadway excavation is suitable to use as embankment unless otherwise noted. 106.04 says if we are choosing to use excavated material, we must separate the excavation into piles for testing for NDOT to approve its use, but if it does not pass we cannot use it & it must be hauled off. We cannot bid the roadway excavation & embankment based on this. We need to know pre-bid, can we use it for onsite embankment or not so we know how to bid, can you please confirm? |

| Answer: As with nesting migratory birds and bats, the contractor will be responsible for any costs related to monarch protection measures. There is no force account for biological compliance. On this project, the Department will provide a biologist to conduct the plant and habitat surveys for the monarch butterfly. |

Can you also confirm that once the area is cleared and fenced, no desert tortoise monitoring will be required? |
| Answer: The Department will provide a biologist for worker education training, tortoise clearance surveys, and potential tortoise relocation/burrow excavation, as well as all construction monitoring. If a material site is to be used, this biologist will conduct tortoise fence inspections. Once cleared and fenced, no desert tortoise monitoring will be required in the material site. The project area along US 95 will not have tortoise fence and will require full-time monitoring, provided by the Department-supplied biologist. |
